§ 1. General
- These Terms set out the rules for using the website at https://codelevel.pl (the “Site”). They are the terms and conditions required by Article 8 of the Polish Act of 18 July 2002 on providing services by electronic means.
- The Site is run by the individual entrepreneur trading as CODELEVEL Przemysław Bińczyk (a natural person running a sole proprietorship), Strączno 78/4, 78-642 Strączno, Poland, registered in the Polish Central Register and Information on Economic Activity (CEIDG), tax ID (NIP) 7651699157, REGON 387373646, e-mail: jacob@codelevel.pl (the “Provider”).
- In these Terms:
- User means anyone who uses the Site;
- Consumer means a natural person within the meaning of Article 22¹ of the Polish Civil Code;
- Sole trader with consumer rights means a natural person entering into a contract directly related to their business, where the contract shows that it is not of a professional nature for that person (Article 385⁵ of the Polish Civil Code).
- These Terms are available free of charge at https://codelevel.pl/en/terms/ before you start using the Site. You can view, save or print them at any time with your browser.
§ 2. Nature of the Site and of the offer
- The Site presents the Provider’s services in IT infrastructure and cloud administration and optimisation (“IT Services”). The IT Services are offered only to businesses and other organisations acting in a professional capacity.
- Any User, including a Consumer, may use the electronic services described in § 3.
- The content of the Site, including descriptions of IT Services, prices, refund terms, calculator results, CSV analysis results and the sample report, is for information only. It is not an offer within the meaning of Article 66 of the Polish Civil Code but an invitation to enter into a contract (Article 71 of the Polish Civil Code).
- Contracts for IT Services are concluded outside the Site, separately, in writing, by e-mail or electronically. The contract, not the Site, governs their terms.
- Point 1 does not limit any rights that mandatory law gives to Consumers or sole traders with consumer rights.
§ 3. Electronic services
- The Provider offers the following services on the Site free of charge:
- access to the content of the Site;
- a contact form for sending a message to the Provider;
- a cost calculator that computes an estimate in the User’s browser; the inputs stay in the page address and are not sent to the Provider;
- analysis of a CSV file from AWS Cost Explorer, run entirely in the User’s browser; the file is not sent to the Provider or stored anywhere;
- the “Are you overpaying for AWS?” quiz, scored in the User’s browser; the answers stay in the page address and are not sent to the Provider or stored anywhere;
- search of the Site’s content;
- file downloads, including the sample report in PDF;
- remembering settings: the choice about visit statistics, in the User’s browser storage.
- Calculator and CSV analysis results are estimates. They are based on providers’ public price lists as of the date shown with the result, on the data the User enters and on the assumptions described on the Site. They are not an offer from the Provider or from the providers named in the result, and they do not replace an analysis of a specific infrastructure. The “Are you overpaying for AWS?” quiz result only shows where savings are worth looking for and gives no amounts.
- The sample report contains sample data that does not come from any client. It only shows the layout and how results are presented.
§ 4. Technical requirements
- To use the Site you need a device with internet access and an up-to-date web browser.
- The contact form, calculator, CSV analysis and search need JavaScript enabled. The form also needs a working e-mail address and access to the Cloudflare Turnstile service. Without JavaScript you can write directly to the Provider’s e-mail address. Without JavaScript the “Are you overpaying for AWS?” quiz works as a list of questions with points that the User adds up.
- To open a PDF file you need a PDF reader.
- The Site does not ask for consent to cookies. If your browser blocks all cookies, Cloudflare’s security check described in § 7(3) may fail, and the Site may then not open.
§ 5. Conclusion and termination of contracts
- A contract for a service under § 3 is concluded when you start using that service. A contract for the contact form service is concluded when you send the form.
- The contract lasts while you use the service. It ends when you leave the Site; for the contact form, when the message is delivered to the Provider or rejected under § 6(2).
- You may stop using the Site at any time, without giving reasons and at no cost.
§ 6. Rules of use
- You may not provide unlawful content through the Site, in particular through the contact form.
- The Provider may refuse a message sent automatically, sent in breach of point 1, or one that did not pass the form’s protections. You can then write directly to the Provider’s e-mail address.
- Actions that disrupt the Site are prohibited, including mass submission of the form and attempts to bypass its protections.
§ 7. Risks and software on the User’s device
- Using the internet involves risks such as malware, impersonation of people or websites (phishing) and interception of data on unsecured networks. The Site works only over encrypted HTTPS connections.
- The Provider will never ask by e-mail, form or phone for passwords, access keys or multi-factor authentication codes for your accounts, including cloud accounts. Access to a client’s infrastructure is agreed only in the contract for IT Services. If you receive such a request signed with the Provider’s name, report it to jacob@codelevel.pl.
- The Site places the following software or data on the User’s device that is not part of the content of the service (Article 6 point 2 of the Polish Act on providing services by electronic means):
- the Site’s JavaScript, which runs navigation, search, the calculator, the “Are you overpaying for AWS?” quiz, CSV analysis, animations, the form and the statistics consent box;
- a
consententry in browser storage (localStorage), written when you choose “Accept” or “Reject” in the statistics box and used only to remember that choice for 12 months; - the Cloudflare Turnstile script, loaded only when you use the contact form, which tells humans from automated programs;
- the Cloudflare Web Analytics statistics script, loaded only with your consent; you can withdraw it at any time with the “Privacy settings” button in the footer;
- Cloudflare technical security cookies (
cf_clearance, sometimes also__cf_bm), set by Cloudflare when its bot protection (Bot Fight Mode) checks the browser or runs a security check.
- Details, including the data processed, are in the Privacy policy.
§ 8. Liability
- The Provider makes efforts to keep the Site working and available but may temporarily limit access to the Site or its features, in particular for maintenance or because of failures on the side of its providers.
- Towards Users who are neither Consumers nor sole traders with consumer rights, the Provider is not liable for damage resulting from decisions based solely on the Site’s content, calculator results or CSV analysis, nor for lost profits, unless the damage was caused intentionally.
- Nothing in these Terms excludes or limits the Provider’s liability towards Consumers and sole traders with consumer rights where mandatory law does not allow it.
§ 9. Complaints
- Complaints about the services under § 3 can be sent to jacob@codelevel.pl or by post to the Provider’s address.
- A complaint should include an address for the reply and a description of the problem. The page address, date and browser also help.
- The Provider handles a complaint within 14 days of receiving it and replies to the e-mail or postal address it came from.
§ 10. Personal data
The Privacy policy explains how personal data is processed.
§ 11. Rights to the content
The Site’s content, including texts, graphics, the calculator and the sample report, is protected by copyright. You may use it within the limits of permitted use, in particular quote extracts with the source. Providers’ names and trademarks belong to their owners.
§ 12. Changes to these Terms
- The Provider may change these Terms for important reasons, in particular a change in the law, in technical providers or in the Site’s features.
- The new version is published on the Site with its effective date, at least 7 days before that date, unless the change follows from the law or security requirements or concerns a new free feature.
- A change does not affect contracts already performed, including messages sent through the form before it takes effect.
§ 13. Governing law and disputes
- Contracts for the services under § 3 are governed by Polish law. This choice does not deprive a Consumer of the protection given by the mandatory law of the country where they habitually reside (Article 6(2) of Regulation (EC) No 593/2008).
- Disputes with Users who are neither Consumers nor sole traders with consumer rights are resolved by the Polish common court competent for the Provider’s place of business.
- A Consumer may use out-of-court complaint and redress procedures available under the law of their country; in Poland, for example, the help of a municipal or district consumer ombudsman.
§ 14. Entry into force
These Terms take effect on 8 October 2026. The Polish version is at codelevel.pl/regulamin/. If the versions differ, the Polish version prevails.
